Stallholder Terms & Conditions


Stallholder Eligibility & Application

● All stallholders must complete the official application form and receive written confirmation of acceptance.

● Subletting or sharing stalls without prior approval is prohibited.

  • Wacky Eats is a community food fair operated by The Market Patch and powered by Moana Harmony Trust. All vendors (“stalholders”) participating in the event agree to the following Terms and Conditions as a condition for trading.

Stall holder requirements

  • Food vendors must hold a valid Food Act 2014 registration or in process of retrieving one and comply with all food safety requirements.

  • All equipment (tents, tables, signage, cords, gas, generators*) must be safe, secure and compliant with NZ regulations.

  • Stall holders must trade for the full event durations unless otherwise approved by the organizer.

Setup & Pack Down

● Setup times - must adhere to setup times on the runsheet provided prior to the event.

● Vendors must quickly unload to site and remove vehicles immediately after unloading. There is limited space at The Green venue and we all need to work together to ensure a calm and respectful pack in.

● Pack down must be completed within the packdown times and only begin once the event officially ends and the public area is clear.

● Stallholders are responsible for their own equipment, signage, and displays.

● All stalls must be neat, clean, safe, and visually appealing.

● Popup marquees must be weighted to the ground securely. NO STAKING PEGS into the ground. This is due to chemical use of the lawn bowls over the years making it unsafe for staking pegs.

Power & Utilities

● All outdoor sites are self powered.

● All electrical equipment must be tagged and tested.

  • Power access is not guaranteed and only a limited number of power sockets will be available for use. Organizers will work towards supplying those requested. No guarantees.

● Generators MUST be pre-approved. Let us know what size and type of generator you will be bringing.

  • If we provide power, you must have RCD connections for us to plug into.

Health, Safety & Cleanliness

● Stallholders must comply with all health and safety regulations, including food safety.

● All stall holders' waste must be removed by the stallholder into the waste bins provided on the day.

● No open flames, hazardous materials, or loud machinery without written permission. ● Stall signage must not be perpendicular to stall site but parallel to stall frontage.

● No marketing boards or flags to be placed beyond your site frontage.

● Stallholders to assist event security in identifying suspicious behaviour and to report immediately to event staff.

  • Keep your area clean and dispose of waste in correct bins.

  • Hot oil, grey water and hazardous waste must be taken off-site.

  • Keep your stall area safe and organized to limit potential hazards.

Insurance & Liability

● The organizer is not liable for loss, theft, or damage to stallholder property.

● Stallholders are responsible for any damage caused to the venue or other vendors.

Stall Presentation & Conduct

● Stallholders must behave respectfully toward event staff, attendees, and fellow vendors. ● No offensive, discriminatory, or inappropriate content or behavior will be tolerated and the organizer has the right to remove the vendor after 1 warning.

No product creeping - Vendors can only sell what was listed on the application form, the organizer has made sure that there is variety and limits on each item available for sale. The organizer will direct the vendor to remove any products not listed on the application form.

● No hawking - Stallholders must not shout from the stall to advertise their items. Stallholders can not use pre-recorded sound projected through speakers to advertise.

● No coyotes - Stallholders must not roam the market to sell, promote or give away samples outside their stall site area.

● Stallholders must not stand in front of your stall site frontage.

● Each stall has a 2 metre “open space” area that dedicates a potential customer to your stall. If a customer is in your 2 metre “open space”, stalls beside you are not allowed to coerce, pitch, sell or direct your customer out of your “open space” range. Potential customers must willingly leave your space to their open space before they can begin their sales pitch.

● Food stallholders will have a service area behind their sites for preparation and cooking. This area must be clean at all times and organized at all times.

Marketing & Promotion

● Stallholders agree to be featured in event marketing materials unless they opt out in writing.

● Use of the “Wacky Eats” name or logo is recommended to promote the stalls and the event.

Cancellation & Force Majeure

● The organizer reserves the right to cancel or reschedule the event due to weather warnings,, safety, or unforeseen circumstances.

● In such cases, stallholders will be notified promptly and refund policies will be outlined.

Refunds

● In the event of a cancellation by the organizer. Stallholders will be 100% refunded minus administration fee of $15.

● In the event of a cancellation by the organizer due to government organizational mandates, a refund of 80% minus administration fee of $15.

● In the event of a cancellation by the stallholder, 100% refund if 21-14 days before the event, 50% refund if within 14-7 days before the event, 10% refund if within 6 days of the event (all minus the non refundable deposit)

● No refunds will be given if the stallholder does not attend their site on the day.

● No refunds will be given if the stallholder is removed by the organizer for any breach in these terms and conditions.

● Refunds will be paid into the same account it received payment from 20 days from the event date.

Profit Share - Early Access Pass, Fast Lane and Lightning Service Lane

  • The event offers paid entry options. These passes generate revenue that supports the event and vendor communities.

  • Qualification - to qualify for the profit share, stallholders must vend for the complete duration of the events. Wacky Eats is a 2 day event.

  • Profit Share Structure: After deducting GST from the total passes revenue. 30% of the net amount is allocated to Moana Harmony Trust and 70% is divided equally among all qualified stall holders who attended and traded for the full event duration (2 days).

  • Payment conditions: Profit share payments will be made within 7-10 days after the event.

  • Profit share will be deposited into nominated bank accounts by the stall holders.

  • Stall holders who pack down early with warning, fail to attend, or breach conditions will forfeit their share.

  • The organizing team will audit the days passes revenue under supervision by a representative of the vendors to sign off on pass revenue.

Liability

  • Moana Harmony Trust is not responsible for loss, theft, damage, or injury caused by stallholder equipment or negligence.

  • Stallholders must ensure they have appropriate insurance if required.

Agreement & Acknowledgment

By the payment of your stall site fee, you agree to abide by these Terms & Conditions. Breach of any clause may result in removal from the event without refund.

Note: To ensure the success of the event for all, we need all stallholders to co-operate with the event organizer and event staff at all times.
